1. Scope of Services
The services provided under this agreement include personal mentoring and language practice, offered by Sophie Li, hereinafter referred to as the "Service Provider"
2. Nature of Service
The Client acknowledges and understands that the mentoring and language practice services provided are of a personal nature and not intended to be professional advice or services. The Service Provider is not a licensed professional counsellor, therapist, or qualified language teacher. Her skills, experience and strategies are entirely her own, and it is up to the Client to accept to disregard.
3. Client Responsibilities
a. The Client is responsible for actively participating in the mentoring and language practice sessions.
b. The Client is encouraged to communicate openly with the Service Provider about their preferences, needs, and any concerns related to the sessions.
4. Confidentiality
All information shared during the mentoring and language practice sessions will be kept confidential, except in cases where the Mentor is legally obligated to disclose information.
5. Payment
Payment for services is to be made in accordance with the agreed-upon terms. The services provided for NDIS client will be in line with NDIS current guidelines. Failure to make timely payments may result in the suspension of services.
6. Scheduling and Cancellation
a. Sessions will be scheduled at mutually agreed-upon times.
b. The Client agrees to provide 48 hours notice prior for any cancellations or rescheduling of sessions.
c. If cancelled within 48 hours, the full cost of the service is charged.
7. Duration and Termination
Either party may terminate the mentoring and language practice services with 48 hours of written notice. The Service Provider reserves the right to terminate the services immediately in the event of any violation of these terms and conditions.
8. Limitation of Liability
The Mentor shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of the provision of services.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Australia.
10. Miscellaneous
a. Any modifications to this Agreement must be in writing and signed by both parties.
b. This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings.
